Terms

The short version
- BackIn5 tells you when someone is waiting at your stall. It can't promise the message arrives, or that you'll see it in time.
- Your name and your logo: you need the right to use them.
- What you write is shown to the public, and it's checked automatically.
- PitchMate is an arrangement between you and another trader. We carry the message; we don't vouch for anybody.
- £5 a month or £50 a year, and £5 means £5 — nothing is added at the checkout. Cancel whenever. Fourteen days to change your mind.
What BackIn5 does
You put a printed sign carrying your QR code at your stall. A customer who finds the stall unattended scans it, and your phone is told somebody is waiting. You answer with one tap from replies you wrote in advance, and they see it on the page they already have open.
Customers need no account and give us nothing about themselves. They are never asked for money or for personal details — by us or on your behalf. BackIn5 is not a way for the public to contact you generally, and it is not a messaging app.
What we cannot promise
This is the part worth reading twice. Getting a message to your phone depends on your signal, your battery, your notification settings and services we do not control. So we cannot promise that a notification arrives, that it arrives quickly, that you will see it, or that anyone will come to the stall.
What we do promise is to be straight about it: when we could not reach your phone, the customer is told that plainly rather than left believing you are on your way.
BackIn5 is not an emergency service. Do not rely on it where a delay could matter to someone's safety.
Your name and your logo
You can set a business name and upload a logo, and they appear on your sign and on the page a customer sees. By adding them you confirm that you have the right to use them and that doing so infringes nobody else's rights.
They stay yours. You are giving us permission to show them for the purpose of running your account, and nothing more. If someone tells us a logo is not yours to use, we may take it down while we ask you about it.
PitchMate
PitchMate is agreed in person, by one trader scanning a code shown on another trader's phone. It is an arrangement between the two of you. We pass on that somebody is waiting; we do not check who anyone is, we cannot promise the other trader will be able to help, and we are not responsible for what another trader does at your stall.
Either of you can end it at any time, and the other is told.
Your account
- Give us details that are accurate, and keep them up to date.
- One account is for one business. Task by task, it is yours.
- Your phone holds the credential that proves it is you. Keep the phone locked, and tell us straight away if you lose it — we can revoke every device and issue a new one without changing your printed signs.
- What happens through your account is your responsibility.
What you write
Your waiting message and your quick replies are shown to members of the public, so treat them as you would a notice on the stall. They are checked automatically for offensive language and for links before they are saved.
Do not use them to advertise something unrelated, to push people somewhere else, or to say anything you would not say across the counter. We can remove text, and if it keeps happening we can close the account.
Maintenance
We may occasionally take the service down to maintain it. We will keep that as short as we can, and we will endeavour to do it outside normal trading hours.
Your information
What we collect, why, and how long we keep it is set out in our privacy notice.
Paying
BackIn5 costs £5 a month or £50 a year. If we have agreed something different with you in writing — a free account, or a different price — that agreement stands for as long as we have said it does.
- The price you see is the price you pay. Nothing is added at the checkout.
- Card payments are handled for us by Stripe, who process the payment and never give us your card details. Your contract is with Andy Griffin, trading as BackIn5, not with Stripe, and your receipt comes from us.
- Subscriptions renew automatically until you cancel.
- You can cancel whenever you like, and you keep the service until the end of the period you have paid for.
Refunds
Within fourteen days of any payment, ask and we will refund it in full. You do not have to give a reason.
After that we do not usually refund the remainder of an annual term — the annual price is lower precisely because it is paid up front. But if the service let you down, or something has gone badly wrong for you, write to us and we will look at it properly rather than point at this paragraph. The refund is ours to give, so there is nobody else to ask and nobody else to blame.
If your Stall Pass ends
Should a customer scan your sign, they will be told that the stall is not using BackIn5 at the moment, that nothing was sent and that nobody was alerted.
Suspending or closing an account
We can suspend or close an account if these terms are broken, if BackIn5 is used to harass anyone, or if the law requires it. We will tell you why unless we are not allowed to. You can close yours whenever you like by emailing us.
If something goes wrong
We will put right what we can. Beyond that:
- We are not liable for lost sales, lost profit, or trade you believe you would otherwise have had.
- Our total liability to you, for everything arising out of the service, is limited to what you have paid us in the twelve months before it happened.
- Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
You are using BackIn5 for your business, so the rules that protect people buying for themselves do not apply to this agreement.
Changes
If we change these terms we will update this page and the date at the top. If a change materially affects you while you are subscribed, we will email you before it takes effect.
Which law applies
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
Who we are
BackIn5 is run by Andy Griffin, trading as BackIn5, a sole trader in England. Write to us at Unit 172917, PO Box 7169, Poole, BH15 9EL, or email hello@backin5.co.uk.
"We" and "us" mean that business. "You" means the trader whose account it is.
